Terms and conditions for alliance with Big Tree Entertainment Ltd


I. Definitions:

1. "Alliance Partner" shall mean Big Tree Entertainment Ltd, which has entered into an alliance agreement with ICICI Bank Limited ("ICICI Bank") for the purpose of providing the Offer
2. “User/s” shall mean person who signs up for participation under the Food section of the live your passion website. www.liveyourpassion.in
3. "Card" shall mean an ICICI Bank Business Debit Card issued by ICICI Bank
4. "Card Holder/s" shall mean such customer/s to whom a Card has been issued and is authorized to hold the Card
5. “Winpin Voucher” shall mean the gift voucher provided by the Alliance Partner on fulfilling the terms below. The value of the said voucher is ₹200.
6. "Offer" shall mean the Winpin Voucher provided by the Alliance Partner on signing up for Food as a passion on www.liveyourpassion.in and submitting a foodie recommendation
7. "Offer Period" shall mean the period starting from July 3, 2017 till first 10,000 signups
8. "Website" shall mean the following website of the "Alliance Partner": www.bookmyshow.com
9. "Void Transactions" shall mean wherein the transaction has taken place but has been rejected /cancelled/unsuccessful at the Website of the Alliance partner
10. "Primary Terms and Conditions" shall mean the terms and conditions applicable to the ICICI Bank’s internet banking facility/service
11. "Products/Services" shall mean the products offered by the Alliance Partner on its Website

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

 

II. Terms and Conditions prescribed to Live Your Passion Food User:

    1. The User may get a bookmyshow voucher worth ₹200 on signing-up under the Food section of live your passion on www.liveyourpassion.in and submitting a foodie recommendation
    2. This offer is applicable only on new sign-ups for the Food section on www.liveyourpassion.in/food and post this users who submit their food recommendation
    3. Sign-ups means completing the ‘Join Us’ form, selecting ‘Yummy food and free restaurant vouchers’ in Your Passion field and logging into your account
    4. Food recommendation can be submitted by completing the recommendation on http://liveyourpassion.in/recommend.aspx#shiftentry
    5. The Offer is valid for first 10,000 Users that sign-up for Food section and submit a food recommendation on our site.
    6. Winpin Voucher e-codes of ₹200 each will be provided to the first 10,000 Users who qualify for the above criteria.
    7. The winners will be declared as per the discretion of ICICI Bank on satisfactory completion of above criteria and other conditions as deemed fit.
    8. The BookMyShow voucher code will be emailed to qualified Users within 30 working days after the offer period ends. The validity of the winpincode is 2 months from the day it was issued.
    10. At any given point, User is eligible for only for one Winpin Voucher as per the discretion of the ICICI Bank. The User shall not be club this Offer with any other offers of the Alliance Partner or ICICI Bank.


III. Winpin Voucher Steps to redeem:-

  1. Log on to in.bookmyshow.com Or BookMyShow mobile app
  2. Select Location, Event, Venue, Show Date & Time and Seats of your preference as the logic flows
  3. On the payment page, go to "Avail Offers & Discounts" & enter the Winpin voucher code in the text box that appears & click on "Check" button to avail the offer.
  4. Note: At the end of the successful transaction booking-id gets generated which needs to be exchanged at the box-office for actual tickets. Email/SMS confirmation will be sent on email address/mobile number provided while completing the transaction.   5. Winpin Voucher Terms and Conditions:
  6. Winpin Voucher(s) can be redeemed ONLY on bookmyshow website/mobile App and cannot be redeemed directly at the cinema/venue box office.
  7. Winpin Voucher(s) can be redeemed on the purchase of tickets for Movies/Plays/Concert/Sport available on bookmyshow website.
  8. Voucher(s) valid PAN India across all Cinemas/Partners associated with bookmyshow.
  9. Winpin Voucher will be adjusted against the tickets cost whereas the online convenience fees or any additional amount transaction to be borne by the user. 
  10. Winpin Voucher(s) can be used Only once within the validity period.
  11. If lost/misused, Winpin Voucher(s) cannot be replaced/refunded and cannot be revalued. Void if resold, cannot be exchanged for point(s) or cash & cannot be re-validated.
  12. In addition to these bookmyshow Winpin Voucher Terms and Conditions, bookmyshow Vouchers and their use on our website are also subject to bookmyshow's general Terms of Use & bookmyshow’s decision will be final in case of any dispute. 
  13. Bookmyshow may change (add to, delete, or amend) these terms from time to time. Unless stated otherwise, the changes will apply to any new bookmyshow Vouchers that are for personal, non-commercial use and enjoyment only. The same may be shared with family and friends, but may not be advertised, sold or used as promotional items by the purchaser or anyone else without bookmyshow's prior written consent


V. Terms and conditions prescribed by ICICI Bank:
1. ICICI Bank employees are not eligible for the Offer.
2. Participation in the Offer by the Users is on voluntary basis.
3. First 10,000 Eligible User(s) shall be sent an email intimation regarding the same.
4. To all first 10,000 eligible User(s), the Winpin Voucher shall be sent to the User(s) on the email address which the User shall provide on registering with us through the ‘Join Us’ form on our site
5. First 10,000 Users who register during the Offer Period shall be eligible for Winpin Vouchers as per the Offer criteria. The Winpin Voucher would be dispatched within 30 working days after the offer period ends
6. This Offer cannot be clubbed with any other Offer that may be made available to the User(s) by ICICI Bank.
7. The Offer is non-transferable, non-binding and non-encashable.
8. In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
9. ICICI Bank does not guarantee and/or warrant and make any representation about the usefulness, quality, delivery worthiness and/or character of the discount / benefit/gift or of the Products/Services which may be provided under the Offer(s) by the respective Alliance Partner
10. ICICI Bank shall not be responsible for any delay(s) or loss that may be caused due to the act(s) or omission(s) of any third party who is responsible for delivery of the goods and services and/or assured gifts / prizes
11. Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the User(s) due to the provision of the Offer, shall be payable by the User/s and ICICI Bank shall hold no liability/responsibility for the payment of such tax or other liabilities or charges. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by User
12. All issues / queries / complaints / grievances relating to the Offer and/or goods, services, if any, shall be addressed to the respective Alliance Partner directly without any reference to ICICI Bank
13. The existence of a dispute/claim, if any, regarding the Offer and/or goods, services shall not constitute a claim against ICICI Bank and shall be resolved by the respective Alliance Partner within such time period as may be stipulated by the respective Alliance Partner
14. ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim/dispute that may arise out of the use of any goods/ services / assured gifts / prizes availed by the User(s) under the Offer offered by the respective Alliance Partner
15. All disputes shall be governed by Indian laws and are subject to the exclusive jurisdiction of the competent courts/tribunals at Mumbai
16. The Offer is not available wherever prohibited and / or on merchandise/gifts /products / services for which such Offer(s) cannot be made available/offered for any reason whatsoever
17. No substitutions or exchange of Offer, other than what is detailed in the communication sent to the User/s shall be allowed. However, ICICI Bank reserves the right to substitute and/or change and/or discontinue with the Offer or any of them, without assigning any reasons or without any intimation or notice, written or otherwise to the User/s
18. ICICI Bank/ the Alliance Partner reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation/notice whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever
19. ICICI Bank reserves the right to disqualify the Alliance Partner(s) or User/s from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purposes of availing the benefits under the Offer or otherwise by use of live your passion website or banking facilities given by ICICI Bank
20. In the event of any User claims arising due to any acts and omission on the part of ICICI Bank or claims or fraud related to credit card/ debit Card, ICICI shall be liable to address such disputes. 21. The participation in the Offer shall be deemed to be acceptance of all the terms and conditions governing the Offer
