• The Participant can be an ICICI Bank customer or a non-customer.
• Last date for submission of entry is October 31, 2020 till 23:59 pm. Any entries beyond such a date and time, will not be entertained.
• The Participant needs to complete his registration formalities on the Live Your Passion website, confirming whether he is a customer with the bank, and submit his Name, City, Registered Mobile Number/Email ID, Corporate Name. Entries without registration details submitted will not be considered as a valid entry.
• Song selected by the participant can only be taken from the ones listed in the contest section of the app.
• Participant can record multiple entries on the Smule app and submit multiple entries for the contest. Each song submitted will be considered as one entry. 
• Participant can post an entry only for self, in order to be considered a valid entry by ICICI Bank for the Contest.
• The entry submitted can be an audio or a video entry on the Smule App.
• By submitting an entry in the ICICI Bank Live Your Passion Indoor Singing Icon Contest, the Participant agrees to the Terms and Conditions of the Contest and warrants that his/her participation complies with all requirements as set out herein.
• All valid entries that are submitted on Smule can be used by ICICI Bank and reposted on its social media, at its sole discretion. The Participant unconditionally agrees to the posting of such a valid entry by the bank.
• Entries must be submitted in the voice of the Participant. Third party entries that do not belong to the participant will be disqualified and will not be considered as a valid entry. 
• ICICI Bank employees are allowed to participate in the Contest; however; they will not be eligible for Prizes other than the assured participation Prize.
• Participants who are not customers of ICICI Bank are allowed to participate in the contest. All participants will be eligible for assured participation prizes.
• Winners will be selected at the sole discretion of ICICI Bank and its third party jury members. ICICI Bank shall notify the winners by contacting them via email or their mobile number registered with the bank.
• Winning entries may be posted on ICICI Bank’s official social media pages.
• By posting a valid entry, you authorize ICICI Bank to contact you for the Indoor Singing Icon Contest related communication.
• Participant can share his/her song entry with friends/family for voting. Public votes for the song entry will be given weightage along with jury scores for the entry. 
• All songs posted on the ICICI Bank Live Your Passion Indoor Singing Icon Contest page are free for the participant. Any song outside the contest section will be charged as per the terms of Smule

TERMS & CONDITIONS
I. DEFINITIONS

• “Affiliates” means any ‘associate company’/’subsidiary company’ (as defined in Companies Act, 2013) of ICICI Bank (defined below);
• "Contest" means ICICI Bank/Live Your Passion Indoor Singing Icon Contest hosted on the Smule App.
• "Contest Period" shall mean the period from 12:00:00 a.m. of September 15, 2020 till 11:59:00 p.m. of October 31, 2020 as per Indian Standard Time.
• “Contest Website" shall mean https://www.liveyourpassion.in
• "Customers" shall mean those individuals who have a banking relationship with ICICI Bank as on October 31, 2020.
• "ICICI Bank" shall mean ICICI Bank Limited, India.
• "Participant”/ “You”/ “Your”/ “He”/ “She" shall mean all those individuals who participate in the Contest.
• "Partners” shall mean ICICI Bank’s sponsor partners and associates of the Contest which includes its alliances with mentioned brands.
• “Prizes” or “Awards” shall mean the Prizes and Awards as mentioned in the Prizes and Awards section on the Contest Website.
• “Terms”/”Contest Rules” shall mean these terms and conditions as applicable to the Contest and such other terms and conditions as may be stipulated by ICICI Bank from time to time.
• “Winner/s” shall mean all those eligible Participants as deemed the most talented by the jury of the Contest and have been declared a Winner by ICICI Bank and are entitled to a Prize or Award basis the Contest Rules.

All capitalized terms used but not defined herein shall have their respective meanings ascribed to it, in the Terms.

II. ELIGIBILITY

• The Participant need not be an ICICI Bank customer. Non-ICICI Bank customers shall not be eligible for Top prizes of the contest.
• ICICI Bank employees can participate in the Contest. They are however, only eligible for participation prizes for valid entries and are not eligible for the Top prizes in the Contest. 
• Participation Prizes, if any, will be given to Participants, subject to entries posted as per the ‘Rules’ stated by ICICI Bank.

III. TERMS PRESCRIBED FOR THE CONTEST

• The Participant needs to post his entry and contact details on the Smule App to submit a valid entry.
• By posting a valid entry, you authorize ICICI Bank to contact you for the Indoor Singing Icon Contest related communication.
• Participant may record songs only in those languages that are available on license on the Smule app contest page.
• For any queries related to the Contest, please write to support@liveyourpassion.in.
• By submitting the entry, each Participant agrees to the Terms and warrants that his/her participation complies with all requirements as set out in the Terms and applicable law.
• This Contest is based purely on the skill/talent/entertainment value of the Participant’s entry and chance plays no part in the determination of the Winners.
• ICICI Bank’s decision pertaining to the Contest and Winners will be final and binding on all the Participants.
• The Participant confirms that his/her participation in the Contest is entirely voluntary and He/She has understood and agreed to the Terms.
• ICICI Bank holds out no warranty or makes no representation with respect to the quality, usefulness, worthiness, delivery or otherwise of goods and services or Prizes offered by the Partner(s) and shall not be responsible/liable in any way whatsoever for the same.
• Any taxes, charges or other liabilities payable to the government or to any other statutory authority/body, or any participating establishment, which may arise or accrue to the Winner due to provision of the Prize, shall be borne solely by the Winner. Tax deducted at source, if any, on the monetary value of the Prize shall be payable by the Winner.
• ICICI Bank reserves the right to disqualify the Participant from the benefits of the Contest if any fraudulent/inappropriate activity is identified as being carried out for the purpose of availing the Prize under the Contest or otherwise for participating in the Contest. The decision made by ICICI Bank unilaterally with regard to disqualification of a Participant shall be final and binding.
• The Contest and the Prizes are subject to these Terms, applicable laws and such other terms and conditions as may be stipulated by ICICI Bank from time to time. The Contest and the Prizes are not available wherever prohibited and/or on merchandise/products/services for which the Contest/Prize cannot be offered for any reason whatsoever.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/damage/claim that may arise out of use or otherwise of goods/services/Prizes offered by the Partner and availed by the Winner under the Contest.
• After the Prizes are duly shared with/handed over to the Winner/s, ICICI Bank shall not be responsible for any loss, damage, theft of the same.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in Prize delivery.
• All issues/queries/complaints/grievances related to the Prize, if any, shall be addressed to Partner directly without any reference to ICICI Bank. The same shall be addressed by the Partner, only up to a period of 30 days after the date of receipt of the Prize.
• The existence of a dispute, if any, regarding the Prize including any claim regarding the usefulness, worthiness, nature and/or quality of it, shall not constitute a claim against ICICI Bank and shall be addressed by the Partner.
• All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai.
• ICICI Bank/Partner reserves the right to modify/change all or any of the terms applicable to the Prize as per its discretion without assigning any reasons or without any prior intimation whatsoever.
• The Winner shall be bound by the terms and conditions stipulated by the Partner/s in regard to the Prizes.
• ICICI Bank reserves the right to revoke/discontinue the Contest or modify/change all or any of the Terms as per its discretion without assigning any reasons or without any prior intimation whatsoever.
• ICICI Bank will not be liable in any manner whatsoever for any loss/damage/injury or claim that may arise due to withdrawal or change in the Terms of the Contest or Prizes.
• These Terms shall apply to all Participants who are also contributors of content forming part of the entries posted by them, including any image/music/song thereunder, as a part of the Contest. The Participant hereby acknowledges and agrees that He/She shall be solely responsible for the content forming part of any entry posted by him/her and the consequences of submitting the entry. The Participant also agrees that He/She shall be responsible for obtaining all model/or property releases, as applicable, in relation to any entry posted by him/her. By posting an entry, the Participant represents and warrants that the entry posted by him/her is an original work within the meaning of the Copyright Act, 1957 and all the rights, including copyrights, publicity, personality and privacy rights, in relation to the same vest solely in him. The Participant has all necessary rights, licenses, consents and permissions to use, and to authorize ICICI Bank and/or its Affiliates to use the entries on any of its platforms or otherwise.  Further, the Participant also represents that the entry does not violate the rights of any third party, including but not limited to copyrights, privacy rights, publicity rights, personality rights, trademarks and/or any other intellectual property rights. The Participant further acknowledges and consents that the sole responsibility for the entry and any content forming part of the entry for the Contest lies with the Participant and ICICI Bank and/or its Affiliates shall not be held responsible, in any manner whatsoever, for any entry posted by the Participant for the Contest and use of the same by ICICI Bank and/or its Affiliates. Further, ICICI Bank and/or its Affiliates shall not be liable, in any manner whatsoever, for any claim, including any claim relating to intellectual property infringement, privacy, publicity and personality rights, relating to or arising out of the entry posted by the Participant and use of the same by ICICI Bank and/or its Affiliates.
• The Participant hereby grants a non-exclusive, sub-licensable, transferable, assignable, perpetual, worldwide, royalty-free and irrevocable license to ICICI Bank and its Affiliates to use, copy, publish, release, edit, reproduce, display, create derivative works, delete or remove any derogatory or defamatory content, print, translate, sub-license, distribute and/or otherwise exhibit, the entry posted by the Participant for the Contest and/or any content forming part of the entry, in any manner and in any medium/forum in India or abroad for advertising, promotional, and/or other purposes as ICICI Bank may solely determine.
• The Participant hereby represents and confirms that the entry and/or any content forming part of the entry subkmitted by him/her for the Contest is not defamatory, invasive of someone’s privacy, objectionable, blasphemous, pornographic, or otherwise unlawful in any manner whatsoever. The Participant further acknowledges that in case of breach/inaccuracy of any of the representations and/or undertakings given by him/her under the Terms, ICICI Bank shall have the right to take any action as it deems fit under applicable law or otherwise.
• The Participant agrees to indemnify and hold harmless ICICI Bank and/or its Affiliates against any claim (including any claim pertaining to intellectual property infringement, privacy, publicity and/or personality rights), loss, liability and damages suffered by ICICI Bank and/or its Affiliates, relating to or arising out of the entries posted by the Participant and/or use of the same by ICICI Bank and/or its Affiliates.
• ICICI Bank may contact the Participants based on information provided in the google form submitted by him/her to seek the following information: Name, Email Id, Mobile No., City, Corporate Name (in case of Corporate Salary Account holders) etc. (“Personally Identifiable Information”). ICICI Bank may use this Personally Identifiable Information to contact you via email, SMS, post or telephone. ICICI Bank’s privacy policy explains how ICICI Bank treats your Personally Identifiable Information and protects your privacy. By participating in the Contest, the Participants agree to allow ICICI Bank authorized use of their Personally Identifiable Information for the purposes of this Contest.

IV. DISCLAIMER
The sole responsibility for any content/entry lies with the concerned person(s)/Participant(s) and ICICI Bank neither endorses nor accepts any responsibility for the same. Nothing contained herein shall constitute or be deemed to constitute an advice, invitation or solicitation to purchase any products/services of ICICI Bank. Any reliance placed on such information will be strictly at your own risk and ICICI Bank will not be liable for any losses or damages in connection with such reliance. ICICI Bank neither holds out any warranty nor endorses or makes any representation with respect to the quality, usefulness, worthiness, delivery or otherwise of goods and services or Prizes offered by the Partner(s). • The ICICI Bank/Live Your Passion Indoor Singing Icon Contest is in no way sponsored, administered by, or associated with Facebook, Instagram, Twitter, LinkedIn and WhatsApp (9920423638) and none of the aforesaid entities shall be responsible or have any liability to the Participant in any manner. Each Participant agrees to release and hold Facebook, Instagram, Twitter, LinkedIn and WhatsApp harmless from and against any and all costs, claims, damages etc.
• ICICI Bank may contact the Participants on their relevant social media accounts to seek the following information: Name, Email Id, Mobile No. etc. (“Personally Identifiable Information”). ICICI Bank may use this Personally Identifiable Information to contact you via email, SMS, post or telephone. ICICI Bank’s privacy policy explains how ICICI Bank treats your Personally Identifiable Information and protects your privacy. By participating in the Contest, the Participants agree to allow ICICI Bank authorized use of their Personally Identifiable Information for the purposes of this Contest.

IV. DISCLAIMER
